Onigbongbo LCDA BYE-LAWS
Enabling Law:
In exercise of the Powers conferred by Section 7 Subsection (7) combined with the Fourth Schedule to the Consititution of the Federal Republic of Nigeria, 1999 and other relevant Sections of the Local Government Amendment Law (No 7) of Lagos State, 2004 and all other powers enabling it in that behalf the Onigbongbo Local Government hereby makes the following Bye-Laws:
SECTIONS:
1. As from the commencement of this Bye-Law every owner Or occupier of Premises, Building and or Tenement, shall Engage or patronise the services of a Private Refuse Operator (PRO), Registered and or licensed by the Onigbongbo Local Government for the purpose of removal, transportation and disposal of refuse from such Building, Premises and or Tenement.
2. It shall be an offence for any unregistered Private Refuse Operator Compulsory To carry on business and or operation within any part of the territorial Registration for Jurisdication of the Onigbongbo Local Government. PRO
3. It shall be an offence for any owner or occupier of any Building or Owner/Tenement within the territorial jurisdication of Onigbogbo Local Government Occupier only To dispose off Refuse other than by and/or through the instrumentality to Patronise. Of Privte Refuse Operator Registered by Ojo Local Government.
4. It shall be an offence for any person whether individual or a body Obsturction of Corporate or unincoroporated to obstruct a registered and or Licensed – PRO or His or Private Refuse Operator or Its agent or delegate in the process of Her Delegate.
Performimg the legitimate duty of refuse collection under these Bye-Law.
5. Any person who contravenes the provision of this Bye-Law shall be Penalized. Guilty of an offence and liable upon convicition to a fine of N2,000.00 Or imprisonment for three (3) months or both if an individual; if a corporate or unincorporated body to a fine of N5,000.00.
6. All tenements, markets,motor parks,stores and other places of business Every Market Shall patronize appointed Private Refuse Operators for collection and Store to Transportation of domestic and other refuse to designated land fill sites.
7. The Local Government shall allocate operational areas to the Registered Provision of Private Refuse Operators. Operational Area by Onigbongbo Local Govt
8. The Private Refuse Operator shall transport all refuse collected from Obligation Private Tenements, Markets, Motor Parks, Stores to approved refuse dump Refuse Collector Site.
b. It is an offence for any Private Refuse Operators to operate outside the operational areas allocated to him/it.
9. The Local Government shall have the power to revoke the license of any Private Power to rovoke Refuse Operator for reason of lack of diligent performance of duties or for any license. Other other reason which in the opinion of the Local Government is in the Interest of Public health.
10. The PRO and Refuse Disposal Monitoring Committee shall consist of the following; Established of PRO and refuse Disposal monitoring committee
(a). 3 Environmental Health Officers from the Area Offices.
(b). 2 C D A members
(c). 2 Neighbourhood Watchers
(d). 2 Members of Market Council
(e.) 2 Armed Police Officers

11. Any Court established under the law of Lagos State shall have Jurisdiction for the Court with Trial of offences under these Bye-Law. Jurisdicition
12. This Bye-Law may be referred to as Private Refuse Operator Operations Bye-Law Citation and
2003 and shall be operational with effect from 27th day of January, 2003. Commencement

ONIGBONGBO LOCAL COUNCIL DEVELOPMENT AREA
PARKING AND CONTROL OF TRAFFIC BYE-LAWS (NO 6) 2003
Enabling Law:
In exercise of the powers conferred by Section 7 combined with the Fourth Schedule to the Constititution of the Federal Republic of Nigeria, 1999 and other relevant Sections of the Local Government Ammendment Law (No 7) of Lagos State, 2004 and all other power enabling it in that behalf the Onigbongbo
Local Government hereby makes the following Bye-Laws:
SECTIONS:
1. As from the commencement of these Bye-Laws, it shall Unauthorised parking out
Be an offence for any person to park or abandon his lawed
Vehicle on the highway or obstruct the free flow of traffic
In any place other than anapproved Car Park within the
Local Government Area of Jurisdication.
2. Where it becomes evident to an authorized person that a impounding of abandoned
Vehicle is parked or abandoned on the highway or in a vehicle
Place other than an approved Car Park or obstructs the free
Flow of traffic, the vehicle involved shall be impounded by the
Authorized person and towed to the Local Premises.
ii. Any person who claims to be the owner or authorized agent Penalty before recovery
of the owner of the vehicle removed pursuant to section 2(i)
above shall be entitled to remove same on payment of the
fees prescribed in the schedule to this Bye-Laws additional
N1000.00 for every subsequent day spent within the Local
Government premises.
3. A minimum parking fee of N20,00 per entry per vehicle shall Fees for parking

Parks so designated within the hours of 6.00am and 6.00pm.
ii. Such person shall obtain an official ticket and show same to Tickets obtaninable

iii. Any person who obstructs an authorized person in the dis Fine for obstruction
charge of his duties under these Bye-Laws is guilty of an offence
and liable on convicition to a fine of N500.00 or to a term of six
months imprisonment or both.
4. Pursuant to the privisions of these Bye-Laws, the Local Govern- Powers and Duties
Ment shall:
a. Provide and maintain parking lots.
b. Develop truck terminals and horizontal high rise and street
Parking lots.
c. Charge fees on Private Commercial Parks
d. Charge and collect fees on Parking lots or any facility provided by it.
e. Issue permits on private parking development.
f. Take necessary steps to prevent indiscriminate or illegal parking of
Vehicles on the street.
g. Enter into contracts for provision, maintenance, control regulation and
Management of parking by the State or under any Law or State
Executive Council fiat.
h. Provide suitable facilities for removal of vehicle contravening Section 1
Of these Bye-Laws.
i. Provide and maintain proper record containing particular of each Cap 1 124
Removed vehicle and its contents specifying the date of it’s removal
And the parking in which it is kept as provided under part 6 of the
Road Traffic Law.
5. The Local Government Supervisor may, in consultation with the Engineer Power to make
And Chief Traffic Officer, make regulations generally for the purpose of regulations
These Bye-Laws.
6. For the avoidance of doubts ,the provisions of these Bye-Laws shall Exemptions
not apply in respect of the following types of Vehicles;Ambulance, Fire
service Vehicle, Hearse and Refuse Collection Vehicle.
7. In these Bye-Laws unless the comtext otherwise requires: Interpretation
Approved Car Park, includes Motor Parks, private parking lots or
Any other place so designated by the Local Government “Authorised
Person”means the Local Government traffic officers, park warden,
Police Officers, designated officials of the Local Government and such
Other persons as the Local Government may from time to time appoint.
“Highway”includes any Road, Street Crescent or alley to which the public
Have access.
“Local Government”means Onigbongbo Local Government
“Local Government Supervisor”means the Local Government Supervisor

‘’Obstruct”meansto hinder, prevent impede, and to make accomplish-

“Vehicle”means a mechanically propelled vehicle intended or adopted
For use on roads and it shall include motor-cycle.
8. These Bye-Laws may be referred to as Parking and Control of Traffic Citation and com
Bye-Laws 2003 and shall become operational with effect from 27th -mencement. Day of January, 2003.

ONIGBONGBO LOCAL GOVERNMENT
CUTTING OF ROAD TAR BYE-LAWS (NO 7) 2003
Enabling Law:
Pursuant to section 7 combined with the Fourth Schedule of the constitution of the Federal Republic of Nigeria 1999, and other relevant Sections of the Local Government Ammendment Law (No 7) of Lagos State 1999 and other powers enabling it in that behalf, theOnigbongbo Local Government hereby makes the following Bye-Laws.
SECTIONS:
1(i). As from the commencement of these Bye-Laws, it shall be an offence Offence
For any person to carry out or engage in cutting of Tar Road or the
Business of cutting of Road Tar without first obtaining a permit from
The Onigbongbo Local Government Council.
(ii) A permit may be obtained on application and upon payment of a mini-
Mum fee of N5,000.00 (Five Thousand Naira) or such amount as may
Be determined by the Local Government from time to time.
2. Any Permit issued shall be for the period specified therein Duration of Permit
3. Any Permit issued under these Bye-Laws shall be produced Production of Permit
By the person to whom it is issued on demand by an authorized
Person.
4(i). Where it becomes evident to an authorized person that the necessary Penalty for failure to
Permit had not been obtained before commencement of work resulting obtain a permit
In cutting of road tar either for purpose of laying of cable arcoss the road
Under these Bye-Laws, the authorized person shall arrest the workman and
Confiscate the equipment found at site.
(ii) The arrested workman and the cofiscated equipment shall be taken to the
Local Government Secretariat or Area Office and shall remain there until
The payment of the fees due for the permit and such levy may be imposed
There on by the Local Government.
5. Any person who obstructs an authorized person in the discharge of his Penalty for obstruction
Duties under these Bye-Laws shall be guilty of an offence and liable on
conviction to a term of six months imprisonment or a fine of N5000 or
both.
6. These Bye-Laws shall apply to all corporate bodies and persons engaged Application
In cutting of Road Tar or Provision of speed breakers, across any road,
Within the jurisdication of the Local Government.
7. In these Bye-Laws, unless the context otherwise requires: ‘’Authorized Interpretation
Means any official of the Local Government or any person who may be
Authorized to perform any function under these Bye-Laws.
“Local Government means the Onigbongbo Local Government.
Cutting of Road Tar include cutting of road or street laid out with
Laterite for purposes of provision of speed breakers, laying of water
Pipes and cables arcoss the road.
‘’Permit means the Licence issued by the Local Government to the
Holder allowing him to carry out the operation of cutting of the road
Or speed breakers, laying across the said road.

ONIGBONGBO LOCAL GOVERNMENT
SAND DIGGING AND FILLING OPERATIONS LICENCE BYE-LAWS (NO8) 2003.
Enabling Law:
Pursuant to section 7 combined with the Fourth Schedule of the consitution of the Fedral Republic of Nigeria 1999, and other relevant Sections of the Local Government Ammendent Law (No7) of Lagos State 1999 and all other powers enabling it in that behalf, the Onigbongbo Local Government hereby makes the following Bye-Laws.
SECTIONS:
1(I). As from the commencement of these Bye-Laws, it shall be an offence Offence
For any person to operate or engage in the business of sand digging and
Filling without first obtaining an operational license from the Local Gove-
Rnment Council.
(ii) A License may be obtained on application and upon payment of a Amount to be paid
Minimum fee of N25,000.00 (Twenty-Five Thousand Naira). For the License and
Form etc.
(iii) A License under these Bye-Laws shall be in the form prescri-
Bed in the schedule to these Bye-Laws.
2(i). Any license issued shall expire on the 31st day of December, of the Expiration and Renewal
Year of issue. Of License.
(ii) Any license issued under section 2(i) of these Bye-Laws shall be
Renewed annually on payment of a prescribed fee.
3. Any change of address of a holder of a license shall be notified Notification of change
Promptly to the office of the Local Government Secretary giving
Serial number and any other authorized person.
4. Any license issued under these Bye-Laws shall be produced by Production of License etc
Such person on demand by an authorized person.
