ONIGBONGBO LOCAL COUNCIL DEVELOPMENT AREA ENVIRONMENTAL SANITATION CONTROL BYE-LAW 2009
Enabling law:
Pursuant to section 7 combined with the Fourth schedule of the constitution of the Federal Republic of Nigeria 1999 and other relevant sections of the local Government Administration law(No.7)of Lagos state 2004 and all other powers enabling it in that behalf, the Onigbongbo Local Council Development Area hereby makes the following Bye Laws.
Section
1(a) it shall be obligatory on all persons(natural or artificial) Duties of owner/occupier
In control or management of any Building, Tenement or property, to ensure the cleanliness of such building, Tenement, premises or its adjoining roads. street, etc Drains, open space on daily basis and at all times generally.
(b) Specially every person (natural or artificial)shall carry out the Clearing/Repairing of:
(i) Building Premises / Property
(ii) All open spaces within and or adjacent to the Building / Premises/ Property up to the middle of the Road
(iii) Frontage of the Building / Premises / Property up to the middle of the Road
(iv) Drains and gutters within and around the premises / Building / Property of all dirt’s and silts.
(v) Silts and Dirt deposited along the verge/ set –back of Public Road within Forty-Eight(48)hours of removal.
2(a) It shall be an offence for the owner /occupiers of any Tenement /Premises to discharge any refuse or waste of any kind or type into any part of such building or Tenement surroundings of such building, Tenement or property.
(b) It shall be offence for any person to litter, sweep into the street, throw ashes, refuse,paper,nylon or waste of any kind into the street, or into any open public place or any vacant plot or land or unoccupied building, premises or property.
(c) It shall be an offence for any person to use or caused to be used heap of refuse or rubbish to fill vacant land, swamp, George, marshy area, drain, canal or channel.
(d) It shall be an offence for any person to refuse to put in Nylon waste/refuse from any market, Restaurants, school, shop, religious premises or other commercial institution preparatory to the actual disposal of such waste or refuse at the designated or approved dump site.
(f) It shall be an offence for any person to burn or bury any Refuse (domestic, commercial or industrial) in any Tenement Building ,Property or public space.
3(a) Every owner / occupier of building /tenement/property shall provide suitable and sanitary refuse bins(s) bags for refuse/ waste collection and temporary stoppage.
(b) Every owner/occupier or building/tenement/ property shall ensure that refuse bins are covered with tight fitting cover at all time.
(c) Every owner/ occupier of building/tenement /property shall use refuse bins,which are leak proof so as to ensure that refuse or dirt does not escaped from such,so that the refuse handlers and the public would not therefore be subject to unnecessary health hazard and injury.
(d) Every owner /occupier shall keep refuse bins within the confines of the buildings, properties or tenements until the time for disposal or collection to designated refuse dump site or delivery to the approved refuse collector.
It is an offence for owner/ occupier to place refuse bins/ bags outside the premises / buildings/tenements at any time prior to the date designated for collection of such bins/bags/refuse.
(e) Every owner of residential building or tenement shall provide sanitary conveniences such as toilet/bathroom and kitchen to be maintained by their users.
4. It shall be an offence for any owner /occupier to erect a permanent slab on top of a drainage which is under than 8 feet. It is however allowed to use manhole to divide any such drainage under than 8 feet in order to facilitates maintenance of the drainage.
5(a) It shall be an offence for any person to use the set-back of building, property or tenement or set-back of public street or road spaces, top of drains etc for the purpose of sales of articles ,display of wares, illegal market ,for auctions or any other trading activities.
(b) It shall be an offence for any owner/occupier of building tenement or property to refuse,neglect or omit to cut or caused to be cut,trim or caused to be cut,trim or caused to be trimed,clear or caused to be cleared the overgrown weeds/grasses/shrubs/flowers,trees in, around or adjacent to the tenement premises or building such as to allow the harbouring of insects, rodents,and dangerous reptiles.
(c) It shall be an offence for any owner/occupier of building tenement or property to fail or neglect to pay on due date the agreed amount due to appointed refuse disposal agents(PSP).
Any owner/occupier guilty of an offence against this sub section will be liable to prosecution.
(d) Any person who contravenes the provision of these Bye law shall be guilty of an offence and liable upon conviction to a fine of N5,000 or imprisonment for three(3)months or both if an individual;of a corporate or unincorporated body to a fine of N20,000.00.
6. All commercial premises, shops, stalls,markets shall observe weekly environmental sanitation every Thursday between 7a.m and 10a.m.
Any premises offending against this provision will be immediately sealed and the owner/occupier prosecuted.
7. Any court established under the law of Lagos state shall have jurisdiction for the trail of offences under this Bye-laws.
This Bye- Law may be referred to as Environmental sanitation/Health and Control Bye-Law 2009 and shall become operational with effect from 30th day April,2009.
